Leave Granted to the ERC Commissioner and Attorney General
Leave has been granted to the Ethnic relation commissioner Carvil Duncan and the attorney general Charles Ramson to respond to the injunction challenging the constitutionality of the ERC.
When the matter was called before Justice James Bovell Drakes in the high court today the attorney for the defendants sought leave to reply to the application.
It is reported that the ERC chairman Bishop Juan Edghill and the other commissioner John Willems is still be served. Capitol news understands that the chairman is out of the country and Willems is out of town.
The opposition PNC/R filed the motion last week on what they cited as the violation of the constitution by the commissioners of the ERC. They are contending that the term in office of the commission has expired since August of 2007 and that the national assembly failed to follow procedures for the reconstitution of the commission.
The injunction is seeking to restrain the commissioners from taking any decision and making any recommendations and or issuing any directive in the name of the ERC.
